KONSEP MAQASHID SYARIAH MENURUT AL-JUWAINI

Abstract

Maqashid Sharia has an important role in finding legal rules that are not explained in the nash, so that it can provide guidelines and rules of life for humans in living life. This paper uses a literature study or literature. The results of this study indicate that maqashid Sharia by Imam Haramain al-Juwaini is known as the earliest scholar who first initiated the theory of Maqashid Sharia. In this case, Al-Juawaini divides maqashid Sharia into two, namely maqashid resulting from istiqra path and ta'aqquli path. Then, Al-Juwaini divides maqasid Sharia (usul al-shari'ah) into five types, namely Sharia that can be reasoned by the intellect and is included in primary affairs (daruriyyah), Sharia related to general needs (hajiyyah / secondary) and does not reach the category of darurah, Sharia which is not related to daruriyyah and hajiyyah, Sharia that is not related to daruriyyah and hajiyyah, but is related to tertiary matters only (makramah), Sharia that is not related to daruriyyah and hajiyyah, but is included in mandub matters, and Sharia that is universal (kulli) has objectives that can be reached by the intellect, but partial (juz'i) cannot be understood by the intellect.
