Abstract

Ahead of the proclamation of Indonesian independence, Islamic leaders tried to fight for Islamic law to be accepted and back in force without any intervention from customary law or Dutch law. The result was an agreement known as the "Jakarta Charter", which contained seven words, namely "Belief in God with the Obligation to Practice Islamic Sharia for its Adherents". However, one day after the proclamation of Indonesia's independence, the seven words were removed and replaced with "God Almighty" in order to maintain the unity of the nation due to demands from Catholics and Protestants to Moh. Hatta. However, independence for the nation also meant that all Dutch regulations had ended, including those based on the receptie theory. Over time, Islamic law during the Old Order period turned out to have a fairly bleak period. In fact, Islamic law at the beginning of independence seemed to have new hope and a strong position in positioning Islamic law in the legal system in Indonesia. Nevertheless, Islamic law still shows its existence with the making of several national laws and regulations that are animated by Islamic law and the source of legal material is Islamic law.
