PENCATATAN PERKAWINAN DALAM PERSPEKTIF HUKUM NEGARA DAN KESADARAN KEAGAMAAN MASYARAKAT

Abstrak

Marriage registration is an important legal instrument for ensuring legal certainty and providing legal protection for married couples and their family members. In practice, the implementation of marriage registration is influenced not only by state legal provisions but also by the community’s understanding and religious awareness regarding the validity of marriage. This study aims to analyze marriage registration from the perspective of state law and the religious awareness of the community, particularly within the context of Pekanbaru City. The study employs a socio-legal approach by examining statutory provisions and the social realities surrounding marriage registration. Data were obtained through literature review, documentation, and interviews with community members and relevant stakeholders involved in the implementation of marriage registration. The findings indicate a close relationship between the community’s understanding of state law and religious awareness in the implementation of marriage registration. Some members of the community perceive marriage registration as a form of legal protection and an administrative obligation, while others continue to place greater emphasis on the religious requirements as the primary basis for the validity of marriage. These differences in understanding may affect the community’s compliance with marriage registration requirements. Therefore, greater harmonization between state law and religious understanding is necessary through improved legal literacy, public education, and stronger cooperation among government institutions, religious leaders, and the community. Integrating these two perspectives is expected to promote more effective marriage registration, strengthen legal certainty, and enhance the protection of families.
